Manassas

Our investigations in Manassas have determined that all of the peddlers are out of compliance, and the Manassas Police Department is aware of this. In Manassas City, if you observe a peddler pushing one of these ice cream carts, contact the police immediately. There is no need for you to approach the vendor. Prince William County (updated)

In Prince William County, it is likely that the same situation exists and the City of Manassas has likely shared information on this issue with the Prince William County Police Department. If you encounter a street peddler, do not approach the vendor, but call the police. Please send us an email about how the police responded to your call so we can track changes in the county's response on this issue. The non-emergency number for the PWC Police Department is 703-792-6500. We can use additional members who reside in the county to help spearhead our efforts in this jurisdiction!

Vendors are required to have a business license which should be posted on their cart, not a photocopy, and each person handling cash is required to have a solicitor's license which bears a photograph of the person. These solicitor's licenses should be plainly visible. Prince William County Code Sec. 18-19.2 paragraph (b) states that any vendors who violate the licensing regulations for "itinerant vendors" is subject to a $200 fine, half of which is to be paid to the person making the complaint.

After some initial struggles by police officers to learn what the code is and how to enforce it, they seem to have a good handle on this and are issuing numerous citations. They report that they have yet to find a pushcart vendor in compliance with the law.

Manassas Park

In Manassas Park, the city has granted licenses to about six or seven individuals. Peddlers are not required to display a license, but must have in their posession a license which looks like a photo ID. If you encounter one of these vendors, ask them to show you their license. If they do not, call the police. If you feel uncomfortable talking to the vendor, you may also call the police and they will investigate. We can use additional members who reside in Manassas Park to help spearhead our efforts in this jurisdiction, especially since the official response in Manassas Park has been completely underwhelming.

UPDATE: The Manassas Park Police Department is reporting that all vendors are properly licensed, although the licensing department only lists these few licensees. It would seem that this issue needs to come before the city council, as there seems to be a glaring disconnect between the police department and the agency issuing licenses.

All Localities

If you have an interaction with a street peddler, you may ask the vendor if his immigration status in the country is legal. He is not required to show it to you, but he may do so in order to complete a sale. If you believe he cannot produce documentation to prove his legal status, he may be in violation of federal law, and you should report him to the police, not for an immigration violation, but for failure to have on his person proof of his legal status. Federal law requires that all aliens in the country maintain with them at all times their green card, visa, or other proof of legal status pursuant to Title 8, Section 1304, Subsection (e) of the United States Code.
